NOTICE REGARDING CRIMINAL BACKGROUND CHECKS IN CALIFORNIA & MICHIGAN
CALIFORNIA DOB REMOVAL INFORMATION
Because of the decision in the All of Us or None – Riverside Chapter vs. W. Samuel Hamrick, Clerk case ( https://www.courts.ca.gov/opinions/documents/D076524.DOCX ), some California Superior courts have been removing the DOB search field from their online portals. As of July 20, these courts have done this: Alameda, Fresno, Kern, Riverside, Santa Clara, Tulare, Ventura, Yuba, LA County, San Bernardino.
It is important to note that as of July 20, 2021, clerks are still verifying DOB in person at the above jurisdictions. However, this will cause a serious delay in turnaround times as in person verifications take more time. PBSA has recently submitted an amicus letter asking the CA Supreme Courts to address this order from the ruling. We are also working on additional strategies to address what we believe is a misinterpretation or misunderstanding of the rule.
MICHIGAN DOB REMOVAL INFORMATION
On Thursday, June 30th, the Michigan Supreme Court issued an order that delays implementation of their rule which would make dates of birth unavailable. The implementation date has been changed from July 1, 2021 until January 1, 2022.
PBSA appreciates the work of the Supreme Court and State Court Administrative Office to delay this rule in order to allow the courts and affected parties to work through solutions.
